New Jersey's Ban on High-Capacity Magazines and the Effect on Police Officers

Updated: Jun 3, 2019

New Jersey's governor recently signed a law that bans magazines capable of holding more than 10 rounds of ammunition. The original text of the law says that any person who "knowingly has in his possession a large capacity magazine is guilty of a crime of the fourth degree...." It also says that law enforcement officers are exempt "while actually on duty or traveling to or from an authorized place of duty, provided that..." the high capacity magazine possession is authorized by the agency.

This is, of course, ridiculous, meaning that off-duty police officers cannot carry their own service weapons.

The New Jersey legislature has passed an amendment and the governor has signed it into law as if December 19th. Off-duty police officers can now carry large capacity magazines holding up to 17 rounds. Magazines holding more than 17 rounds can only be carried if the weapon is an issued service weapon.

We have heard that the NJ PBA will ask for an amendment in next year's legislative session to exempt retired police officers.
