New Law Affecting Ticket Sellers in NYC


New York City has enacted a new law that will take effect on August 1, 2016. The new law governs anyone who sells tickets in a public place for any place of entertainment, mode of transportation, or guided tour.


The law requires that anyone selling such tickets must first obtain a license from the NYC Department of Consumer Affairs. The law also places many restrictions on the ticket sellers.


First, it is unlawful to vend in aggressive manner, which includes approaching, speaking to, or following a person if such conduct is likely to cause a reasonable person to fear bodily harm, damage to or loss of property, or the commission of a penal law offense, or otherwise be intimidated into giving money or an item of value, among other things.


Second, the location of ticket selling has restrictions. For example, ticket sellers cannot operate within a bus stop (except that a seller employed by a mode of transportation or guided tour may sell tickets within the bus stop designated for use by that mode of transportation by NYC DOT). They may not operate within 10 feet of any driveway, within 20 feet of any subway entrance or exit, or within 10 feet of any corner.


They may not vend within a World Trade Center zone and police officers may direct ticket sellers to temporarily move from an otherwise authorized location in the event of exigent circumstances, which may include heavy traffic (pedestrian or vehicular), parades or demonstrations, or other obstructions.
